TERMS OF SERVICE AND SALE

1. SELLER AND SCOPE
The CULPAM online store is operated by Culpam LLC (“CULPAM,” “we,” “us” or “our”).
These terms govern use of our store and purchases from us. Our Shipping Policy and Returns and Refunds Policy also apply to purchases. Our Privacy Policy explains how we handle personal information.
Nothing in these terms excludes rights that applicable law does not allow us to waive.
2. CUSTOMERS AND ACCOUNTS
We currently accept orders for delivery within the United States.
To place an order, you must be legally able to enter into a contract or have a parent or guardian place the order on your behalf.
Provide accurate contact, payment and delivery information. Use only payment methods you are authorized to use. Keep your account credentials secure.
3. PRODUCTS
Review the product description, materials, care instructions and size chart before ordering. Some items are made to order.
Screen settings and production methods may cause minor differences in color or print placement. This does not excuse supplying a defective or materially different product.
United States manufacture or dispatch is not promised unless expressly stated for the particular product.
4. ORDERS AND PAYMENT
Submitting an order constitutes a request to purchase the selected products at the disclosed price and terms.
An automated order receipt acknowledges submission. Acceptance occurs when we confirm acceptance or dispatch your order.
We may decline or cancel an order for a legitimate reason, including unavailable goods, suspected fraud or a material listing error. We will notify you and promptly refund payments for merchandise we do not supply.
We will not increase the price or materially change an accepted order without your agreement.
5. PRICES, TAXES AND SHIPPING
Prices are displayed in United States dollars (USD). Applicable taxes and shipping charges are disclosed at checkout before payment.
Shipping rates and free-shipping thresholds are explained in our Shipping Policy. Items covered by separate shipping profiles may generate separate shipping charges.
Promotions are subject to their stated conditions. Additional charges payable to us must be disclosed before purchase.
6. SHIPMENT AND DELIVERY
Our Shipping Policy explains production, shipment, delivery and the handling of delays.
We will follow applicable requirements for delay notices, consent, cancellation and refunds.
The involvement of a production partner or carrier does not remove our obligations as the seller or your mandatory remedies for delayed, lost, damaged or undelivered goods.
7. RETURNS AND CANCELLATIONS
We do not offer voluntary returns or exchanges for change of mind, buyer’s remorse or an incorrectly selected size.
Remedies for defective, damaged, incorrect or undelivered goods remain available under our Returns and Refunds Policy and applicable law.
Contact us immediately about cancellation or changes. Voluntary cancellation may not be possible after production begins. Mandatory shipment-delay and other legal cancellation rights remain unaffected.
8. INTELLECTUAL PROPERTY
Store content, designs and branding belong to Culpam LLC or their respective owners.
You may use the store’s normal shopping functions for lawful purposes. These terms do not grant permission to copy, sell or commercially exploit protected designs or content. Exceptions and rights provided by law remain unaffected.
9. REVIEWS AND SUBMISSIONS
You retain ownership of reviews or content you submit. You grant us a nonexclusive, royalty-free license to display and reproduce that content as reasonably needed to operate and promote the store.
You must have the necessary rights to submit the content and disclose any incentive received for a review.
We may moderate unlawful, misleading, infringing or abusive content. We do not prohibit honest negative reviews or penalize customers for expressing an honest opinion.
10. PROHIBITED USE
Do not use the store for fraud, impersonation, unlawful activity, infringement, malware or unauthorized access.
Do not interfere with security or collect other users’ personal information without authorization.
We may restrict access for violations. This does not remove our obligations relating to existing orders or mandatory refunds.
11. SHOPIFY AND OTHER PROVIDERS
Our store is hosted by Shopify. Purchases are made from Culpam LLC, not from Shopify.
Production partners, payment providers, carriers and other third parties may have their own terms and privacy notices. Using these providers does not transfer our obligations as the seller to them.
12. WARRANTIES AND LIABILITY
We do not guarantee uninterrupted or error-free access to website features.
Nothing in these terms excludes applicable product warranties, rights to goods that match their description, or remedies that cannot lawfully be excluded.
To the extent permitted by applicable law, we are not liable for indirect or consequential losses arising from use of website features.
This limitation does not exclude liability for fraud, willful misconduct, gross negligence, personal injury or defective products where exclusion is prohibited, or our obligations to supply goods or issue required refunds.
Where a limitation is not permitted, applicable law controls.
13. LAW AND DISPUTES
Applicable United States federal and state law governs to the extent legally applicable. Mandatory protections of the state in which you reside remain unaffected.
These terms do not impose mandatory arbitration or an exclusive court venue.
Contact us if you would like help resolving a problem. Contacting us does not limit your legal remedies.
14. CHANGES AND EXISTING ORDERS
We may update these terms prospectively by publishing a revised version and effective date and providing any notice required by law.
The terms and policies disclosed when an order was placed continue to govern that order.
If a provision is unenforceable, the remaining provisions apply to the extent permitted by law.
